These General Terms and Conditions of Sale & Service apply to your use of the Giftcart.com website at www.giftcart.com (the “website”) and to any order you place with Giftcart Ecommerce Private Limited. The Website Terms apply regardless of how you access the Website, including any technologies or devices by which M&S makes the Website available to you. You must read these Websites Terms carefully.
OPENING AN ACCOUNT AND PLACING AN ORDER:
You can place an order on Giftcart.com as a guest or by opening an account with Giftcart.com. While doing this process you will have to provide us with some compulsory personal information.
You warrant that all information and details provided by you to us (including on registration) are true, accurate and up to date in all respects and always. You can update or correct your details at any time by going to Your Account.
When you create an account, we may provide you with and/or ask you to use passwords or other means to allow you to access certain areas of the Website and/or to maintain your account security. It is your responsibility to maintain the confidentiality of your password and account information. Giftcart shall not be liable to any person for any loss or damage which may arise because of any failure by you to protect your password or account. Placing an order:
The technical steps required to create the contract between you and us are as follows:
You place the order for your products on the Website by pressing the place order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website.
We will send to you an order acknowledgment email detailing the products you have ordered. This is not an order confirmation or order acceptance from Giftcart.com.
As your product is shipped from our warehouse we will send you a despatch confirmation email.
Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us. Our acceptance of your order will take place only when we dispatch the product(s) or commencement of the services that you ordered from us.
We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. The duration of our contract with you will start from when you order and we take payment and dispatch the products, until the last day of your right to cancel.
Non- Acceptance of an order may be a result of one of the following:

We accept demand drafts and cheques. For proof of payment, you need to send a scanned copy of your DD/cheque to email@example.com. Please note that the order will only be shipped once the amount has been credited to our bank account.
All products ordered will remain the property of Giftcart until we have delivered the products to the address specified by you. If your payment is not received and you have already received the products you ordered from us, you must pay for or return those products to us in accordance with our reasonable return instructions and in the same condition that you received them at your own expense. If you do not do this within xx days of the date on which we cancel your order, we may collect or arrange for collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

Giftcart.com offers easy replacement only in the case of damaged or incorrectly supplied goods. Giftcart.com reserves the right to offer you any one the three below mentioned options:
1. Send a replacement product once the customer returns the damaged product/products
2. Refund the amount only in the case where Giftcart.com cannot offer a replacement. The refund will be issued as store credit which will not include the handling charges and taxes
*Giftcart.com, in its sole discretion, will determine the usage of the given options.
What do I do if the product I received is damaged or incorrectly supplied on delivery?
You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery, you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (Customer Service Department by phone or email only) within 48 hrs of receipt of the items. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied.
Applicability of Replacement Policy:
Giftcart.com will accept Replacement or Exchange only if the following conditions are met.
1. Replacement request should be initiated within 48 hrs of order delivery.
2.Customershouldinformus that the products are damaged or have been incorrectly supplied within 48 hrs of order delivery.
3. A photograph of the product along with the packaging should be emailed to firstname.lastname@example.org within 48 hrs of order delivery.
4. The item needs to be returned along with the original packaging if requested by Giftcart.com. The package should be returned within 15 days from initiation.
5. The tags on the product should be intact.
6. The product should be unwashed, unused and in an undamaged condition
Please note the below conditions that apply to the replacement claim.
1. Replacement for goods/ merchandise is subject to inspection and checking of returned product by Giftcart team.
2. Replacement for goods/ merchandise will be initiated only once Giftcart receives the return package
3. Damages due to neglect, improper usage or application will not be covered under our Replacement Policy.
4. Some special rules for promotional offers may override "Giftcart.com 10 Days Replacement Policy."
5. Please note that the Cash on Deliveryconveniencecharge,andhandlingcharges wouldnotbe included in the refund value of your order as these are non-refundable charges.
6. In the case where the quality of any products, services, information, or other material purchased or obtained by you through the website did not meet your expectations,nocompensation willbegiven other than the replacement of the product or store credit. Giftcart.com, in its sole discretion, will determine the usage of the given options.
7. If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and for this reason, we recommend that you use an approved carrier service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amount attributable to) such loss or damage.
8. We receive returned goods only through approved carrier service providers and you cannot return the goods in person physically to the Replacement Department.

What products, services and scenarios are not covered under the Replacement policy?
Applicability of the “Replacement Policy”donotapply to the below products, services and scenarios:
- Perishable items such as flowers, plants, fruit baskets and other consumable items
- Custom made or personaliseditems
- Hygienerelateditemsnamely lingerie and earrings
- Watches and perfumes
- All electronic items & appliances, ,media (CD/DVDs)
- Gratify eGiftcards
- Any products with a seal where the seal is broken.
- Any consumable item which has been used or installed
- Replacement request is made outside the specified time frame
- Productisdamaged because of use or Product is not in the same condition as you received it
- Defective products which are covered under the manufacturer's warranty
- Anything missing from the package you've received including price tags, labels, original packing,freebiesandaccessories
- Items which were sold as combos/sets,arenot eligible for exchange/replacement as individual items
Do I get a reimbursement of courier charges for returns?
The courier charge will be refunded only in the case of damaged or incorrectly supplied items. To claim refund

Giftcart.com will notify you when we've received your return package. The courier charge will be refunded only once we receive the package and the same has gone successfully through our quality check.
Damage during the course of returning products: If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and for this reason, we recommend that you use an approved carrier service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amount attributable to) such loss or damage.
Personalized items, imported gift items, Giftcart imported electronics, toiletries, cosmetics, bra accessories, earrings for pierced ears, food, gift cards, gift vouchers, furniture, large technology items, large appliances, flowers, plants, perfumes, fragrances, sunglasses, watches, books, Digital Storage Disc (DVD/CD), opened bedding, opened technology products. These items can only be refunded or replaced in accordance with your legal rights. Additional Terms and Conditions of Sale & Service apply to some of these items..

Giftcart.com assumes no responsibility for the traded products relating to faultyormis-describedinformationthat if otherwise results in any injury or death due to the negligence or errors in the workmanship of the product or your misuse. Giftcart.com offers only authentic, genuine and original products from the leading suppliers and brands; however, there is no guarantee to assure that these products will work fault free or that theseproductsdosatisfyyour needs. As a trading partner, we hold no liabilities whatsoever arising out of the use or misuse of the products you have purchased from Giftcart.com. For more information on products that we are trading through Giftcart.com, please visit the respective Brand owner’s website.
Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, (incorrect or damaged)you can contact us for a Replacement. Please check our Replacement Policy for details. We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms by anything you (or anyone acting on your behalf) does or fails to do or due to events, which are beyond our reasonable control.
You must follow any advice we (or the manufacturer) give you to keep products, we supply to you, safe (including any instructions or product manuals provided with the products or website links on Giftcart.com or on the manufacturer’s website). We cannot accept liability for damage toproductswe have supplied, which is caused by your failure to follow this advice.
In any event, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.
Giftcart.com allows cancellation only when cancellation is requested within 24 hours of placing the order by calling us at +91 99 1064 4899 Mon-Sat (9am-6pm) or emailing us at email@example.com provided that the product has not already been shipped.
All refunds will be made within 10 business days from the date of cancellation.
Applicability of cancellation rights:
The above mentioned cancellation policy does not apply to any item or service which is a "customized order (made to order) such as apparel, cushions, gift hampers or experiential gifts", flowers, candles, plants, food, perishable items or special imported gifts or electronics, perfumes, cosmetics, toiletries, fragrances, lingerie, innerwear, jewellery, sunglasses, watches, books, Digital Storage Disc (DVD/CD) and other personalised items.

How can I cancel my order?
You can cancel your order with Giftcart.com by requestion cancellation within 48 hours of placing the order by calling us at +91 99 1064 4899 Mon-Sat (9am-6pm) or emailing us at firstname.lastname@example.org.
All refunds will be made within 10 business days from the date of cancellation. Theabove mentionedcancellation policy does not apply to:

*Please note that the Cash on Delivery convenience charge and the handling and processing charge would not be included in the refund value of your order as these are non-refundable charges.
Under what circumstances will my order be automatically cancelled?
In the event of non-delivery of items due to incomplete/wrong address or continuous unavailability of person at the shipping address to receive the items from carrier, the order will be cancelled automatically and the two way carrier service and handling charges will be deducted from your card payment, and the balance shall either be refunded or given as a Cart credit at the sole discretion of Giftcart.com. This does not apply to
a) Perishable items such as flowers, plants, fruit baskets and other consumableitems
b) Custom made or personalised item.
c) The product goes out of stock and Giftcart.com is unable to offer a replacement.
What are the products for which Gifcart.com will not accept cancellations?
We do not accept cancellations for any of thebelow mentioneditems:
- Customized order (made to order)/personalised items
- Experiential gifts
- Flowers and Plants
- Food, perishable or consumable items
- Gratify eGiftcards
Can I cancel the order if there is a delay in delivery?
If you experience an abnormal delay ofadditionaltwo weeks from the committed delivery day ( as mentioned on the product description page) ,then you may choose to cancel the order for claiming a full refund. Thetwo waycarrier service and handling charges will be deducted from your card payment, and thebalance shall eitherbe refunded or given asa storecredit at the sole discretion of Giftcart.com.
*Please note that the above condition will not apply to delivery delayed due to bad weather conditions, natural disasters and political unrest.

How do I check the status of my order?
You will receive an email from Giftcart.com to confirm that we have received your order. You may also check the order status on your “My Account” pages on the website. If you are unable to view the status of your order, please feel free to contact the Customer Service Centre.
What are the various modes of payment that Giftcart.com accepts?
Giftcart.com accepts payment by Master/Visa Credit cards, Debit cards and Net Banking from most of the banks in India.
We accept Cash On Demand (COD) payments against deliveries provided the billing and shipping address is the same, and the person ordering and the person receiving the shipment is the same. We do not accept COD Terms for amounts higher than Rs 15,000 per each order for each customer in one cycle. We do not accept COD Terms if the item shipped is a gift item and if the item shipped requires a wrapper. We do not accept COD Terms for all the personal and custom made-to-order products such as Apparel, Flowers & Food items and special import orders. We do not accept COD Terms from a person who has refused a shipment in the last one year.
We accept Gratify e-Giftcards and Giftcart Vouchers online. Please note that we do not accept cheques, pay orders or demand drafts as a method of payment for retail business. We also do not accept American Express and PayPal payments as of now.
