The General Terms are applicable throughout the order cycle management starting from ordering, payment, shipping, delivery, refunds or returns, cancellations or Cart credits to customer service.

Placing an order

  • As your product is shipped from our warehouse we will send you a despatch confirmation email.
Order Acceptence
  • Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us. Our acceptance of your order will take place only when we dispatch the product(s) or commencement of the services that you ordered from us.
  • We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. The duration of our contract with you will start from when you order and we take payment and dispatch the products, until the last day of your right to cancel.
Order Non-acceptance

Non- Accptence of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock.
  • Our inability to obtain authorisation for your payment.
  • The identification of a pricing or product description error.

GIFT MESSAGES

If you order a product or service as a gift for your family, a friend or a relative, Giftcart.com may offer you the opportunity to add a gift message to your purchase. If you choose to use the gift message service, you acknowledge and agree that:

  • The gift message service is provided for your own personal and non-commercial use only
  • The gift message you instruct us to send on your behalf to a third party will not contain anything which could be construed as harassing, threatening, vulgar, abusive, obscene, defamatory, racist or which may cause embarrassment or distress to any person or which is otherwise unlawful or objectionable
  • You will not impersonate any person, including but not limited to any of our employees or customers
  • You are entirely responsible for the text and other content of your gift message and Giftcart.com accepts no responsibility or liability for any such content or outcome as a result of your message
  • We do not pre-screen or edit messages, but may monitor content from time to time for the purpose of guarding against unlawful or inappropriate gift message
  • We have the right to refuse to send messages and to terminate access to the gift message service at any time and without liability to you

PAYMENT TERMS

During the checkout process, you will be asked to enter your payment details. By completing your payment details you confirm that the credit or debit card being used is yours. All fields indicated as compulsory must be completed. Please note that we may collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy and Cookie Policy.

Giftcart.com will accept the following payment terms for all orders placed online by the customers:

Credit card/Debit card/Net Banking:

>Master/Visa Credit cards and Debit cards, Net Banking from most of the banks in India. You need to have your own Credit Card or Debit Card with relevant information such as Credit Card billing address, Credit Card/Debit Card Number, name written on the Credit/Debit card, expiry date, billing address with Pin code (Zip code) and Verified by Visa/ Mastercard Securecode password to complete the authenticated payments through our payment gateway which is safe and secure. We do not store your card information except the last four digits of your credit/debit card for security purposes. If you prefer to make the payment through Net Banking, you need to have your bank account login and password and transaction passwords to complete the transaction. Giftcart.com does not allow you to use third party credit/debit cards or personal bank accounts even if they authorize you. We don’t accept American Express and PayPal payments as of now. In case of a High Value Order, we may ask you to produce additional documents such as an ID Proof (Voter ID Card, PAN Card or Passport) and a front copy of the Credit/Debit Card displaying your name and a credit card statement with your billing address.

Cash on Delivery:

Cash on Delivery (COD) is available for many of our products, for order values between INR 300.00 – INR 15000.00, and supported for most PIN codes across India. If your pin code is not in this list then you will be not be able to place the order on COD and have to choose another payment option. COD service has a handling fee of INR 100.00 per order. Please note that COD needs to be applicable for all the products in your cart. When you opted for COD, you will only be able to pay by cash, we will not accept cheques, demand drafts or gift vouchers. Excluded from COD are all the personal and custom made-to-order products such as apparel, flowers & food items, personalised gifts and special import orders. We do not accept COD Terms from a person who has refused a shipment in the last one year. Gratify eGiftcard or Store Credit cannot be used for C0D orders.

All orders under COD are subject to our further verification and acceptance. In order for us to verify your COD eligibility, we may ask you to produce additional documents such as Voter ID Card, PAN Card and other ID proofs such as a passport. Giftcart.com reserves the right to refuse a COD without revealing the reasons for the refusal.

Cheque and DD:

We accept demand drafts and cheques. For proof of payment you need to send a scanned copy of your DD/cheque to cx@giftcart.com. Please note that the order will only be shipped once the amount has been credited in our bank account.

All products ordered will remain the property of Giftcart until we have delivered the products to the address specified by you. If your payment is not received and you have already received the products you ordered from us, you must pay for or return those products to us in accordance with our reasonable return instructions and in the same condition that you received them at your own expense. If you do not do this within xx days of the date on which we cancel your order, we may collect or arrange for collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

DELIVERY TIME AND CHARGES

Delivery time and Charges

Delivery time vary depending on the type of products ordered. Delivery time is mentioned on the website against each item and is given as accurately as possible but cannot be guaranteed to be exact in nature due to circumstances beyond our control like bad weather natural disasters, political unrest, package missing from courier etc.

*For flowers and selected combo gifts we offer same day, next day and midnight delivery options. The same can be checked and selected on the product page.

If you experience an abnormal delay of additional two weeks from the committed delivery day ( as mentioned on the product description page) , then you may choose to cancel the order for claiming a full refund. The two way carrier service and handling charges will be deducted from your card payment, and the balance shall either be refunded or given as a store credit at the sole discretion of Giftcart.com.

Giftcart.com does not ship outside India at this moment, and deliveries can be made at most of the locations in India as specified on the website. Certain items cannot be delivered to a few locations where our carrier service is not available. Please ensure to check for the availability of delivery service for your shipping destination at the time of order completion on the website.

Please note that our gifts are dispatched from different ware houses spread across India. In the case where you have ordered more than one item, we might need to send your order in more than one package.

Same day Delivery: received by 3 pm will be delivered the same day (except National Holidays) to most India addresses,(at peak times we may require orders to be place earlier).

Fixed time Delivery: Order should be recived a day before by 3 pm. To order a fixed time delivery , please mention the time while placing the order. We will do our best to accommodate your preferences; however we cannot commit sharp/exact time for delivery. Delivery time available 10am to 9pm. Kindly allow for (+) (-) 10 - 15 minutes fluctuation in delivery timings

Midnight Delivery: Order should be recived a day before by 3 pm Your order is delivered around midnight on the same date as mentioned by you in the calendar. Please select the date carefully while placing the order. For example: If in the calendar you choose the date 16th August then the delivery will be made between 11:30pm to 11:59pm on the 16th of August.

In case of delivery to Hotels, Hospitals and Marriage or Banquet Halls, delivery will be made at the reception.

Delivery attempts and cancellations

Delivery will be to the India or international address or store specified in your order. Giftcart.com’s carrier will deliver between 10 am and 6 pm on all working days (excluding National Holidays) in most of the locations as specified on the website. If no one is available at a residential or other address at the time of delivery, a note will be left to advise the arrival of the shipment followed by a text message or a telephone call.

All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are handed over to the carrier for delivering at the address specified in your order.

Where the supply of your product(s) or service(s) delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

In the event of non-delivery of items due to incomplete/wrong address or continuous unavailability of the person at the shipping address to receive the items from the carrier, the order will be cancelled automatically and the two way carrier service and handling charges will be deducted from your card payment, and the balance shall either be refunded or given as a Store Credit at the sole discretion of Giftcart.com. Giftcart.com shall not deliver to one of the family members on your behalf (in case of residential address) or shall not deliver to one of your colleagues (in case of factory or office establishment) in your absence unless the carrier service provider does on his own at the latter’s risk. In the event of your refusal to receive the shipment from the carrier willfully, then your order will be cancelled automatically and the two way carrier service and handling charges will be deducted from your card payment. Remaining balance card payment collected from you if available, shall be offered to you back in the form of Cart credit. In case of any non-obtainability of carrier service charges and handling charges due to non-delivery for the reasons a) delivery refusal b) continuous unavailability, Giftcart.com will send its claim to you for settling the payment within 15 days, failing which your future rights to buy from Giftcart.com will be banned for a limited period.

International Delivery

Due to customs, legal, regulatory and certain practical restrictions applicable to orders placed for international delivery, some of our products may not be available for delivery to certain destinations outside India. Giftcart reserves the right to define what can and cannot be delivered to which destination.

International Payment - Purchases will be made in dollars. International credit card providers or banks will determine the exchange rate and may add an additional processing or administration charge in relation to such payment which international credit card holders will be liable to pay.

Giftcart.com products are sold on a delivery duty unpaid basis. The recipient may have to pay import duty or a formal customs entry fee prior to or on delivery. Additional taxes, fees or levies may apply according to local legislation and customers are required to check these details before placing an order for international delivery.

REPLACEMENT POLICY

Giftcart.com offers easy replacement only in the case of damaged or incorrectly supplied goods. Giftcart.com reserves the right to offer you any one the three below mentioned options:

Send a replacement product once the customer returns the damaged product/products

Refund the amount only in the case where Giftcart.com cannot offer a replacement. The refund will be issued as store credit which will not include the handling charges and taxes

What do I do if the product I received is damaged or incorrectly supplied on delivery?

You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery, you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (Customer Service Department by phone or email only) within 48 hrs of receipt of the items. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied.

Applicability of Replacement Policy:

Giftcart.com will accept Replacement or Exchange only if the following conditions are met.

Replacement request should be initiated within 48 hrs of order delivery.

Customer should inform us that the products are damaged or have been incorrectly supplied within 48 hrs of order delivery.

A photograph of the product along with the packaging should be emailed to cx@giftcart.com within 48 hrs of order delivery.

The item needs to be returned along with the original packaging. The package should be returned within 15 days from initiation.

The tags on the product should be intact.

The product should be unwashed, unused and in an undamaged condition

Please note the below conditions that apply to the replacement claim.

*Replacement for goods/ merchandise is subject to inspection and checking of returned product by Giftcart team.

*Replacement for goods/ merchandise will be initiated only once Giftcart receives the return package

*Damages due to neglect, improper usage or application will not be covered under our Replacement Policy.

*Some special rules for promotional offers may override "Giftcart.com 10 Days Replacement Policy."

*Please note that the Cash on Delivery convenience charge, and handling charges would not be included in the refund value of your order as these are non-refundable charges.

*In the case where the quality of any products, services, information, or other material purchased or obtained by you through the website did not meet your expectations, no compensation will be given other than the replacement of the product or store credit. Giftcart.com, in its sole discretion, will determine the usage of the given options.

*If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and for this reason, we recommend that you use an approved carrier service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amount attributable to) such loss or damage.

*We receive returned goods only through approved carrier service providers and you cannot return the goods in person physically to the Replacement Department.

What products, services and scenarios are not covered under the Replacement policy?

Applicability of the “Replacement Policy” do not apply to the below products, services and scenarios:

Perishable items such as flowers, plants, fruit baskets and other consumable items

Custom made or personalised items

Hygiene related items namely lingerie and earrings

Watches and perfumes

All electronic items & appliances, , media (CD/DVDs)

Gratify eGiftcards

Any products with a seal where the seal is broken.

Any consumable item which has been used or installed

Replacement request is made outside the specified time frame

Product is damaged because of use or Product is not in the same condition as you received it

Defective products which are covered under the manufacturer's warranty

Anything missing from the package you've received including price tags, labels, original packing, freebies and accessories

Items which were sold as combos/sets, are not eligible for exchange/replacement as individual items

Do I get a reimbursement of courier charges for returns?

The courier charge will be refunded only in the case of damaged or incorrectly supplied items. To claim refund

Damage during the course of returning products: If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and for this reason, we recommend that you use an approved carrier service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amount attributable to) such loss or damage.

Personalized items, imported gift items, Giftcart imported electronics, toiletries, cosmetics, bra accessories, earrings for pierced ears, food, gift cards, gift vouchers, furniture, large technology items, large appliances, flowers, plants, perfumes, fragrances, sunglasses, watches, books, Digital Storage Disc (DVD/CD), opened bedding, opened technology products. These items can only be refunded or replaced in accordance with your legal rights. Additional Terms and Conditions of Sale & Service apply to some of these items.

NOTE: Exchange is subject to the issuance of Return Merchandize Authorization (RMA) that will determine whether the ordered goods can be returned or not.

Giftcart.com offers only authentic, genuine and original products from the leading suppliers and brands; however, there is no guarantee to assure that these products will work fault free or that these products do satisfy your needs. As a trading partner, we hold no liabilities whatsoever arising out of the use or misuse of the products you have purchased from Giftcart.com. Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, (incorrect or damaged)you can contact us for a Replacement. Please check our Replacement Policy for details. We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms by anything you (or anyone acting on your behalf) does or fails to do or due to events, which are beyond our reasonable control.

You must follow any advice we (or the manufacturer) give you to keep products, we supply to you, safe (including any instructions or product manuals provided with the products or website links on Giftcart.com or on the manufacturer’s website). We cannot accept liability for damage to products we have supplied, which is caused by your failure to follow this advice.

In any event, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.

CANCELLATION POLICY

Giftcart.com allows cancellation only when cancellation is requested within 24 hours of placing the order by calling us at +91 99 1064 4899 Mon-Sat (9am-6pm) or emailing us at cx@giftcart.com provided that the product has not already been shipped.

All refunds will be made within 10 business days from the date of cancellation.

How can I cancel my order?

In the event of non-delivery of items due to incomplete/wrong address or continuous unavailability of person at the shipping address to receive the items from carrier, the order will be cancelled automatically and the two way carrier service and handling charges will be deducted from your card payment, and the balance shall either be refunded or given as a Cart credit at the sole discretion of Giftcart.com. This does not apply to

a) Perishable items such as flowers, plants, fruit baskets and other consumable items

b) Custom made or personalised item.

The product goes out of stock and Giftcart.com is unable to offer a replacement.

What are the products for which Gifcart.com will not accept cancellations?

We do not accept cancellations for any of the below mentioned items:

  • Customized order (made to order)/personalised items
  • Experiential gifts
  • Flowers and Plants
  • Food, perishable or consumable items
  • Gratify eGiftcards

Can I cancel the order if there is a delay in delivery?

If you experience an abnormal delay of additional two weeks from the committed delivery day ( as mentioned on the product description page) , then you may choose to cancel the order for claiming a full refund. The two way carrier service and handling charges will be deducted from your card payment, and the balance shall either be refunded or given as a store credit at the sole discretion of Giftcart.com. *Please note that the above condition will not apply to delivery delayed due to bad weather conditions, natural disasters and political unrest.

RESALABLE CONDITIONS (IN CASE OF EXCHANGE)

All the products we ship are brand new and come with the original packaging. Giftcart.com does not sell second hand or used or pre-owned products on its website www.giftcart.com. When you as a consumer want to return the products within 7 days from the date of receipt (after obtaining the Return Merchandize Authorization number from Giftcart.com), you must make sure the products under return should not be tampered with, should not be used or worn (except in case of trial once without removing the original tags), should not be washed or dry cleaned or pressed with iron (in case of apparel), should not be broken or damaged (by you). All the products must be in their original packing with all the inner packing material, manuals and accessories. Price tag should not be tampered with or removed or smudged.

LIABILITY

Giftcart.com assumes no responsibility for the traded products relating to faulty or mis-described information that if otherwise results in any injury or death due to the negligence or errors in the workmanship of the product or your misuse. Giftcart.com offers only authentic, genuine and original products from the leading suppliers and brands; however, there is no guarantee to assure that these products will work fault free or that these products do satisfy your needs. As a trading partner, we hold no liabilities whatsoever arising out of the use or misuse of the products you have purchased from Giftcart.com. For more information on products that we are trading through Giftcart.com, please visit the respective Brand owner's website.

Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, you can contact us for a Replacement or Goodwill Exchange during the first 7 days from the date of receipt. After 7 days, you will need to contact the manufacturer or service center for repairs or replacements as the case may be. All the products we ship will carry warranty or after sales service related information either in the form of printed documentation or a website link.

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms by anything you (or anyone acting on your behalf) does or fails to do or due to events which are beyond our reasonable control.

You must follow any advice we (or the manufacturer) give you to keep products, we supply to you, safe (including any instructions or product manuals provided with the products or website links on Giftcart.com or on the manufacturer's website). We cannot accept liability for damage to products we have supplied which is caused by your failure to follow this advice.

In any event, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.
